When people go to work in Portland, there is an expectation that they will be able to go, do their work and go home. In order to do this people need working conditions that allow this to occur. If people do not receive the support or given the resources they need, it can make it difficult to do though. It can also be difficult if supervisors or co-workers sexually harass others. This type of behavior has been put in the spotlight recently, but many people may not know exactly what behavior is considered sexual harassment.

Definition of Sexual Harassment

There are many different behaviors that can be considered sexual harassment, however, one of the first requirements is that the conduct is unwanted. It can include overt sexual advances, requests for sexual favors or other conduct of a sexual nature. The sexual conduct can include making acceptance of the sexual advance as a condition of employment or used when making promotion decisions. However, it can also simply create an environment that is intimidating or offensive, which affects people’s ability to effectively do their job.

Types of Sexual Harassment

There are two general types of sexual harassment that occurs in the workplace. One is quid pro quo harassment and the other is hostile work environment. Quid pro quo harassment occurs when superiors make the sexual favors as a requirement for favorable treatment. It can also occur if denial of the sexual favor is used when making decisions regarding promotions, shift changes, raises, work conditions and other aspects of the job.

Hostile work environment harassment occurs when supervisors or co-workers say sexually explicit things, display pictures sexual in nature, touch others inappropriately or other conduct of a sexual nature which creates a difficult and distressing work environment.

Potential Remedies

The potential remedies for sexual harassment depend on the adverse effects the victim suffers as a result of the harassment. If the victim lost out on a promotion or a raise, the remedy could include giving the victim the position or opportunity they lost, compensating them for lost income, benefits, bonuses and other forms of compensation or providing a similar opportunity for the victim. They could also potentially receive income for the emotional distress they experience or other psychological effects of the harassment. In addition to that the victims could also receive compensation for the costs and expenses they incur for legal action they need to take.

Many people in the Portland area experience different forms of sexual harassment in the workplace. This can be very detrimental to victim in a variety of ways. The victims may be able to receive compensation for the damages they suffer as a result though.
